Terms of Service

1. Introduction & Acceptance

By accessing or using VoiceCraft, you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, do not use the service. These Terms form a binding agreement between you and VoiceCraft (“we,” “us,” or “our”).

You must be at least 18 years old to use VoiceCraft. By creating an account, you represent that you have the authority to bind the business entity you register on behalf of.

These Terms incorporate by reference the Privacy Policy, the Acceptable Use Policy, and the Data Processing Addendum. In the event of a conflict, the order of precedence is: a signed Order Form, then these Terms, then the incorporated policies.

2. Description of Service

VoiceCraft is a voice AI platform that creates and manages AI-powered phone agents for businesses. The platform includes AI voice agents that handle inbound calls, appointment booking, SMS and WhatsApp messaging, an AI builder for agent configuration, forms with configurable data retention, a contact CRM with optional HubSpot and Google Calendar sync, and call analytics.

Voice-Commerce features relay orders to the Customer's configured POS system (Square or Clover) for pay-at-pickup or external payment processing. VoiceCraft does not process payments.

We may modify, suspend, or discontinue features at any time with reasonable notice.

3. Account Responsibilities

You are responsible for:

  • Maintaining the security of your account credentials
  • All activity that occurs under your account
  • Providing accurate and complete business information for your agent configuration
  • Promptly notifying us of any unauthorized access to your account

4. Subscription & Billing

VoiceCraft offers subscription plans as described on our pricing page.

  • Subscriptions renew automatically unless cancelled before the renewal date
  • You authorize us to charge your payment method for recurring fees
  • Refunds are handled on a case-by-case basis. Contact support for requests.
  • We may change pricing with 30 days' notice before your next billing cycle

Free trial

A 14-day free trial is available to first-time Pro and Business plan subscribers (excluding pay-as-you-go and re-subscribers). The trial includes 50 included minutes and a single-agent cap.

Free tier

The free tier provides 50 one-time minutes for browser test calls only. Free-tier agents cannot be connected to a phone number for live inbound calls.

Daily spend caps

To protect against runaway usage: the Free tier has a $5 daily cap, Pay-as-you-go has a $50 daily cap. Pro and Business plan customers may configure per-organization caps.

Failed payments and dunning

Failed payments transition the subscription to PAST_DUE status. After Stripe's automatic retry cycle is exhausted (approximately 10 days), the account is paused and agents stop accepting inbound calls. Payment information may be updated through the Stripe customer portal to reactivate.

Cancellation

You may cancel your subscription at any time through the Stripe customer portal. Cancellation takes effect at the end of the current billing period. Access continues until then.

5. Acceptable Use

Customer shall comply with the Acceptable Use Policy located at /acceptable-use, which is incorporated into these Terms by reference. The Acceptable Use Policy describes prohibited content, telephony and messaging compliance obligations, healthcare and PHI restrictions, and reporting procedures.

Customer is solely responsible for compliance with the Telephone Consumer Protection Act (TCPA), the CAN-SPAM Act, A2P 10DLC carrier rules, CTIA Messaging Principles, and all other applicable messaging laws. The end-user consent disclosures for SMS sent through VoiceCraft are documented at /sms-consent, which forms part of the customer-facing notice required by carrier policy. Customer is also solely responsible for compliance with Meta's WhatsApp Business Messaging Policy for any WhatsApp use.

6. AI and Automated Processing

VoiceCraft provides services powered by artificial intelligence, including automated voice agents that interact with Customer's end-users by telephone. VoiceCraft uses third-party AI providers, such as Anthropic, Google, OpenAI, Deepgram, and ElevenLabs, to operate these services.

VoiceCraft does not use Customer Content to train, retrain, or fine-tune AI or machine-learning models, and contractually requires the same commitment from its AI sub-processors. Customer Content includes call recordings, transcripts, message bodies, and business configuration data Customer provides.

AI-generated responses may not always be accurate. Customer is responsible for reviewing and testing agent behavior before deploying it to handle live calls or messaging. VoiceCraft does not guarantee the accuracy, completeness, or appropriateness of AI-generated content. Customer assumes full responsibility for the agent's interactions with end-users.

7. Your Content & Data

You retain ownership of all data you submit to VoiceCraft, including your business information, contacts, call recordings, transcripts, and content.

You grant us a limited license to process your data solely for the purpose of delivering the service. This license terminates when you delete your data or close your account.

8. Third-Party Services

VoiceCraft integrates with third-party services including Twilio, Plivo, LiveKit, Deepgram, Google Calendar, Microsoft Outlook, HubSpot, Square, Clover, and others. Your use of these integrations is subject to the respective third-party terms and policies.

We are not responsible for the availability, accuracy, or conduct of third-party services. We may add, modify, or remove integrations at any time.

9. Healthcare Disclaimer

VoiceCraft is not a medical or healthcare service. The platform is not currently designed to process Protected Health Information (PHI) as defined under HIPAA.

VoiceCraft does not offer Business Associate Agreements (BAAs) at this time. You must not collect, store, or transmit PHI until VoiceCraft has explicitly enabled HIPAA mode for your organization and a signed BAA is in place.

You are solely responsible for ensuring your use of the service complies with healthcare regulations applicable to your business.

10. Intellectual Property

The VoiceCraft platform, brand, technology, and documentation are our property or licensed to us. Your business data, contacts, recordings, and content remain your property.

Nothing in these Terms transfers ownership of either party's intellectual property to the other.

11. Warranty Disclaimer

VoiceCraft is provided “as is” and “as available” without warranties of any kind, whether express or implied.

We do not warrant that the service will be uninterrupted, error-free, or secure. We do not warrant the accuracy of AI-generated responses or configurations.

We disclaim all implied warranties including merchantability, fitness for a particular purpose, and non-infringement, to the maximum extent permitted by law.

12. Limitation of Liability

To the maximum extent permitted by law, our total liability to you for any claims arising from or related to the service is limited to the fees you paid to VoiceCraft in the 12 months preceding the claim.

We are not liable for any indirect, incidental, consequential, or punitive damages, including but not limited to lost revenue, missed appointments, or damages arising from AI agent behavior.

13. Indemnification

Customer indemnification

You agree to indemnify and hold VoiceCraft harmless from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of the service, your agent's interactions with callers, your violation of these Terms, or your violation of any applicable law. This includes claims arising from the content or behavior of AI agents you configure and deploy.

VoiceCraft indemnification

VoiceCraft agrees to indemnify and hold you harmless from any third-party claims alleging that the VoiceCraft platform itself (excluding Customer Content and Customer configurations) infringes a third party's intellectual property rights, provided that you: (a) give us prompt written notice of the claim; (b) grant us sole control over the defense and settlement; and (c) provide reasonable cooperation. This obligation does not apply to claims arising from your modifications to the platform, your content, or your use of the platform in combination with third-party services not approved by us.

14. Termination

You may cancel your account at any time through your dashboard or by contacting support.

We may terminate or suspend your account for violation of these Terms, with notice where practicable. Upon termination, access is revoked immediately. Your data is retained for 30 days to allow retrieval, then permanently deleted.

Sections that by nature should survive termination, including liability, intellectual property, indemnification, and disclaimers, will survive.

15. Governing Law

These Terms are governed by the laws of the State of Delaware, United States. Any disputes arising from these Terms will be resolved in the courts of Delaware.

You agree to attempt good-faith resolution before pursuing legal action.

16. Changes to These Terms

We may update these Terms from time to time. Material changes will be communicated via email at least 30 days before taking effect.

The “Last updated” date at the top of this page reflects the most recent revision. Continued use of the service after changes take effect constitutes acceptance.
